3.3 Reasons for the decision to award

Reasons: The supplements are project adjustments and additional requirements of the client, in connection with and following the tender 177915 (simap project-ID), for the pavilion within the available budget.
In particular, these were elements that were not conclusively known at the time of the award, as well as a revision of individual elements of the client's two exhibition rooms that was necessary due to COVID, as well as the optimisation of the pavilion from an operational and qualitative point of view.
Tendering and awarding the contract to a third party would have led to very high costs for interface management between the client, the contractor Expomobilia and an alternative general contractor and would have additionally slowed down and made the project more expensive. The alternative general contractor would have had to familiarise himself with the plans of the Swiss Pavilion, which were unknown to him, and would have had to charge time for this effort. The same applies to any subcontractors. Thus, for technical and economic reasons, it would not have made sense to have the additional services carried out by another contractor.

4.5 Procedures for appeal

In accordance with Article 56 paragraph 1 of the Public Procurement Act (PPA), a written appeal against this decision can be lodged with the Federal Administrative Court, P.O. Box, 9023 St. Gallen, Switzerland, within 20 days of notification. Any appeal is to be submitted in duplicate and must include what is being sought, the grounds for appeal, evidence and the signature of the person lodging the appeal or his or her representative. A copy of this decision and available evidence must be included.
The provisions of the Administrative Procedure Act (APA) on legal holidays do not apply in accordance with Article 56 paragraph 2 of the PPA. Based on Article 52 paragraph 2 of the PPA, the appeal can be used only to establish that this decision violates federal law, but not to apply for its cancellation. Foreign providers are permitted to appeal only to the extent that the state in which they are domiciled grants reciprocal rights.
