1.4 Deadline for submitting offers

Date: 14.04.2020 Time of day: 16:00, Specific deadlines and formal requirements:  The comple and legally signed proposal, together with all the requested supplements, has to be submitted in two hard copies (one original and one marked colour copy).
Additionally, two USB-sticks with the complete proposal have to be submitted. In case of discrepancies between the
paper and the electronical submissions, the signed physical offer shall be valid.
The bids must be received by Nagra latest at the stated deadline. Bids arriving after this deadline will not be evaluated and will be rexcluded from the tender.

2.6 Subject and scope of the contract

In line with international practice, the Swiss waste management concept calls for deep geological disposal of radioactive waste. With a view to the submission of the general licence application, it is amongst other things necessary to evaluate and develop the existing concepts for the following aspects:
- Emplacement of the disposal containers
- Backfilling and sealing of the drifts and caverns, including the selection of suitable materials
- Closure of access structures
- Retrieval of disposal containers
Within the framework of the tendered contract, the relevant site-independent (generic) concepts of the aspects listed above are to be further developed, evaluated and advanced to the maturity level of a generic preliminary project.

At the offices of the client (Wettingen, Switzerland) and if necessary at the potential geological siting regions (Northern Switzerland).

3.6 Subcontractor

Sub-contractors are allowed. All sub-contractors must be specified in the bid. If proof of suitability of an award criterion is provided with the details of a sub-contractor, the latter has to carry out the foreseen sub-contractor work. The main component (>60%) of the services offered must be provided by the bidder or bidder consortium.

3.7 Eligibility criteria

SC1: The bidder’s experience regarding technical planning or conceptual development of complex underground or mining facilities in the preliminary study phase (definition of the construction project, feasibility study, selection procedure) including the following aspects:
1. Backfilling of drifts, tunnels or caverns
2. Closure of underground facilities
Evidence: A comparable, completed (with respect to phase) reference project per aspect; investment cost of the facility of at least CHF 20 million (excluding VAT). In the case of suitability, both aspects can be demonstrated within the same project.

SC2: Experience of the key person Project Manager in the phase concept development, preliminary study or construction project for complex underground or mining facilities.
Evidence: A completed (with respect to phase) reference project with similar complexity and investment cost of at least CHF 50 million (excluding VAT) as interdisciplinary project manager or deputy project manager.

SC3: Availability of key persons. The tasks of the key persons require a high presence and flexibility over the entire duration of the project; their availability must be assured for the entire duration of the project (excluding optional services).
The following availability is required
- for the duration of the basic contract, for the key person Project Manager a 20% workload on a quarterly basis
- for the key person Technical Planner Backfilling a 20% workload on a quarterly basis
- for the key person Technical Planner Closure and Sealing a 30% workload on a quarterly basis
- for the key person Technical Planner Emplacement and Retrieval a 30% workload on a quarterly basis
All services are to be rendered in person (by the offered personnel). The required capacity may vary considerably over the duration of the project.
With the submission of the offer, the bidder confirms the availability of the key persons.

SC4: Sufficient quality management system of the bidder.
Proof of a company-specific (at least of the lead company) quality management system (ISO 9001 or comparable).

4.4 Essential requirements

The Operator will sign the contract only with partners, which commit to comply with the occupational health and safety
regulations and working conditions valid for employees in Switzerland and in the specific location for the performance
of the work. Furthermore, for the services performed in Switzerland under the Project or the Work, the Contractor commits to maintain wage equality for men and women.

4.6 Additional information

1) Nagra reserves the right to directly award further similar tasks related to this basic contract (submission decree of the
canton of Aargau § 8, para. 3, lit. i).
2) Excluded companies: Gähler und Partner AG (GPAG) currently holds a mandate as a staff unit for the main project ABU and therefore is excluded from the tender.

4.8 Procedures for appeal

1. An objection against this tender can be made within 10 days from its publication at the Administrative Court of Canton of Aargau, Obere Vorstadt 40, 5001 Aarau. The standstill of deadlines in accordance to the Swiss civil procedure law does not apply in this case.
2. The objection has to be submitted in written form and should contain a motion and a justification. This includes:
a) the indication on how the Administrative Court should decide
b) and to demonstrate on which grounds this decision should be made
3. An objection which does not comply with the requirements described under Points 1 and 2 will not be taken into consideration.
4. The contested tender should be specified, and all the possible evidence should be described and enclosed whenever possible. The objection has to be signed.
5. The contestant has to assume that a cost risk is associated with any objection: as a general rule, the losing party shall bear the procedural costs and, if applicable, the attorney fees of the adverse party.
