2.6 Subject and scope of the contract
- We provide highly specialized multilayer coatings and customized neutron optics devices and
we are looking to further push the possibilties in neutron optics by adding a new sputtering device to our lab. The device is designated to develop novel recipes of neutron optical multilayers and to produce large quantities with established recipes. Furthermore, it will also be used for research coatings of single and multilayer for other applications with a large variety of target materials. The machine is research-oriented with small-batch processing options. Its functional criteria are reproducibly uniform layers over a thickness range from 0.1 to 100 nm with a uniformity of 1% on both sides of the substrate. 4.4 Essential requirements
- The client only awards public commissions for services in Switzerland to tenderers who comply with job security
regulations and the conditions of work for employees, and provide equal payment for men and women. The bidder and the instructing party undertake to take all necessary measures to avoid corruption, in particular that no payments, gifts or other advantage will be offered or accepted. Should this integrity clause be disregarded, the contractor must pay a contract penalty. This will amount to 10 % of the contract value, a minimum of CHF 3’000.- percontravention. The bidder should take note that a contravention of the integrity clause generally results in the annulment of the tender and the premature termination of the contract for important reasons by the instructing Party.

4.8 Procedures for appeal- In accordance with Article 56 paragraph 1 of the Public Procurement Act (PPA), a written appeal against this decision can be lodged with the Federal Administrative Court, P.O. Box, 9023 St. Gallen, Switzerland, within 20 days of notification. Any appeal is to be submitted in duplicate and must include what is being sought, the grounds for appeal, evidence and the signature of the person lodging the appeal or his or her representative. A copy of this decision and available evidence must be included.
The provisions of the Administrative Procedure Act (APA) on legal holidays do not apply in accordance with Article 56 paragraph 2 of the PPA.
