1.4 Deadline for submitting offers- Date: 14.03.2023, Specific deadlines and formal requirements:
The complete tender must be sent by 14 March 2023 at the latest (date of postmark) in triplicate (2 copies on paper, one copy on USB stick) to the address in accordance with section 12.1 of the specifications.
Remark on the submission of tenders:
a) When submitted to the Swissmedic box (by the bidder or courier): Submission must be made no later than the above-mentioned submission deadline, still during the opening hours of the lodge (i.e. Monday to Thursday, 08.00 - 12.00 / 13.30 - 17.00 and Friday 08.00 - 12.00 / 13.30 - 16.00, address as per section 12.1 of the specifications, against issue of a confirmation of receipt by Swissmedic.
b) In the case of submission by post: The postmark or barcode receipt of a Swiss or state-recognised foreign post office is decisive for meeting the deadline (company frankings are not regarded as postmarks).
If the offer is submitted by post, the offeror must ensure that the offer has reached Swissmedic by 17 March 2023 at the latest. The latest submission date by post remains 14 March 2023.
c) When the offer is submitted to a diplomatic or consular representation of Switzerland abroad: The provider is obliged to inform Swissmedic of the place of submission (incl. address) by e-mail to (markus.diethelm@swissmedic.ch) 10 days before the expiry of the submission deadline. In addition, it is obliged to send the confirmation of receipt of the corresponding representation to the contracting agency by e-mail by the submission deadline of the offer at the latest. The bidder must in any case ensure proof of the timeliness of the tender submission.
Tenders submitted too late can no longer be considered. They will be returned to the bidder.

4.8 Procedures for appeal- In accordance with Article 56 paragraph 1 of the Public Procurement Act (PPA), a written appeal against this decision can be lodged with the Federal Administrative Court, P.O. Box, 9023 St. Gallen, Switzerland, within 20 days of notification. Any appeal is to be submitted in duplicate and must include what is being sought, the grounds for appeal, evidence and the signature of the person lodging the appeal or his or her representative. A copy of this decision and available evidence must be included.
The provisions of the Administrative Procedure Act (APA) on legal holidays do not apply in accordance with Article 56 paragraph 2 of the PPA.
