1.4 Deadline for submitting offers- Date: 08.05.2024, Specific deadlines and formal requirements:
The complete offer must be sent in triplicate (2 copies in paper form, single copy on USB stick) by 8 May 2024 (date of postmark) at the latest to the address specified in section 12.1 of the specifications.
Note on the submission of tenders:
a) When handed in at the Swissmedic box (by supplier or courier): The submission must be made by the above-mentioned submission deadline at the latest, still during the opening hours of the box (i.e. Monday to Thursday, 08.00 - 12.00 / 13.30 - 17.00 and Friday 08.00 - 12.00 / 13.30 - 16.00, address as per Chapter 12.1 of the specifications, against issue of a Swissmedic acknowledgement of receipt.
b) If submitted by post: The postmark or barcode receipt from a Swiss or state-recognised foreign post office is decisive for compliance with the deadline (company frankings do not count as postmarks).
When submitting by post, the bidder must ensure that the bid has reached Swissmedic by 15 May 2024 at the latest. The latest submission date by post is 8 May 2024.
c) When submitting the offer to a Swiss diplomatic or consular representation abroad: The offeror is obliged to inform Swissmedic of the submission location (incl. address) by e-mail to (markus.diethelm@swissmedic.ch) 10 days before the submission deadline. In addition, it is obliged to send the confirmation of receipt of the corresponding representation to the client by e-mail at the latest by the deadline for submission of the offer. In all cases, the bidder must ensure proof of the timeliness of the submission of the tender.
Tenders submitted too late can no longer be considered. They will be returned to the bidder.

- With this tender, Swissmedic is procuring a triple quadrupole mass spectrometer system with a (U)HPLC, including qualification, maintenance, support and training. The procurement is intended to cover the entire lifecycle of approx. 15 years. Detailed information can be found in the tender specifications.

4.8 Procedures for appeal- In accordance with Article 56 paragraph 1 of the Public Procurement Act (PPA), a written appeal against this decision can be lodged with the Federal Administrative Court, P.O. Box, 9023 St. Gallen, Switzerland, within 20 days of notification. Any appeal is to be submitted in duplicate and must include what is being sought, the grounds for appeal, evidence and the signature of the person lodging the appeal or his or her representative. A copy of this decision and available evidence must be included.
The provisions of the Administrative Procedure Act (APA) on legal holidays do not apply in accordance with Article 56 paragraph 2 of the PPA.
