2.6 Subject and scope of the contract

We are looking for an EDR solution that can be set up and operated “on the premises” with a sensibly coordinated architecture within an SBB network perimeter. It should fulfil the following criteria:
• The solution must ensure that endpoints that do not have access to a public network can be protected
• The solution must be operable “on the premises” using a central management console
• The solution must support Windows and Linux systems from the last 25 years
• The central management console must have multi-client capability so that each organisational unit has its own dashboard for administering its endpoints.

Description of renewals: The licencing and support agreement is concluded for a term of five (5) years, with the option to extend this five (5) times by one (1) year each time.

SBB makes a fixed award for SP1 to the best-placed bidder (successful tenderer). SBB concludes the contract for SP1 with this company. The other SPs are retained as options.
All companies receive an option to provide services. If SBB decides to terminate the contract with the successful tenderer, SBB will conclude a contract according to the ranking order within the first 24 months of the award. If one of these other companies expressly declares to SBB that it is waiving its option on all service packages for the provision of services, this company is no longer bound by its offer and the corresponding reserved services.

If the applicant qualifies for the bid stage, the following applies:
Bidders will have the opportunity to present the subcontractors they intend to work with to SBB as part of the questions round. They will complete the ‘Questions_TDs+Contract’ document and send it to SBB in accordance with the provisions of the questions round. When answering the questions, SBB will notify the relevant bidder of any objections it may have to a sub-contractor. In this case, the bidder will either undertake the work without this sub-contractor or substitute that sub-contractor for another.
When submitting their bid, the bidder will have to declare any sub-contractors in the annex ‘Contract amendments’. If the bidder uses sub-contractors, they will have to submit this for each sub-contractor whose service elements are to be used.

4.4 Essential requirements

The contractor shall award this contract only to bidders who comply with the conditions stipulated in the tender documents and the legislation, in particular occupational health and safety regulations, rules on working conditions, equal pay regulations, as well as environmental law, competition law and anti-corruption provisions.

SBB may only accept bids from Switzerland/the EU/EFTA or the UK.

4.8 Procedures for appeal

In accordance with Article 56 paragraph 1 of the Public Procurement Act (PPA), a written appeal against this decision can be lodged with the Federal Administrative Court, P.O. Box, 9023 St. Gallen, Switzerland, within 20 days of notification. Any appeal is to be submitted in duplicate and must include what is being sought, the grounds for appeal, evidence and the signature of the person lodging the appeal or his or her representative. A copy of this decision and available evidence must be included.
The provisions of the Administrative Procedure Act (APA) on legal holidays do not apply in accordance with Article 56 paragraph 2 of the PPA.
