a) Submission to Swiss customs administration: Submission is required by 16:00 h at the latest on the day of the aforementioned submission deadline. An acknowledgement of receipt from Swiss customs administration must be requested. Delivery by private courier service is considered personal delivery and the tender must be submitted to the Swiss customs administration by 16:00 h at the latest (please request an acknowledgement of receipt without fail).
b) Submission by mail: The date of submission is confirmed by the postmark or bar code receipt of a Swiss post office, or for tenderers abroad the acknowledgement of receipt of a Swiss diplomatic or consular representation, (company postage will not be regarded as a postmark).
c) When delivering a tender to a Swiss diplomatic or consular representation abroad, the tenderer is required to fax the acknowledgement of receipt issued by the relevant representation to the contracting authority by no later than the closing date for the tender offer.

2.6 Subject and scope of the contract
- The Public Procurement Competence Centre of the Directorate General of Customs (DGC) has been tasked with publishing a new invitation to tender for security x-ray machines.
The security x-ray machines of the Federal Customs Administration (FCA) are at the end of their operational lives and must be replaced in stages. The initial procurement through the WTO procedure should allow the oldest machines to be purchased and replaced within the next five years and at the same time should ensure that the same type of appliance will be used in the FCA in the years ahead.

All companies with sufficient economic capacity, which meet the following criteria and proof of suitability acc. to para 3.8, are invited to submit a tender in CHF.

In the set of requirements below, the assessment criteria have been created as follows:
E1 – E11 are mandatory criteria (M), they have to be fulfilled by the tenderer. The ways and means of fulfilment must be briefly described and proven. If a mandatory criterion has not been fulfilled, further participation in the procedure is excluded.
E12 – E20 are assessable criteria. Only the first three tenderers will be taken into account. Here, the resulting ranking of the tenderers will be based on the assessable suitability criteria. All tenderers with the same number of points as those placed third will also be taken into account.
E1: Commercial register, debt collection register Extract from the debt collection register and commercial register or document from abroad recognised as being equivalent (no older than three months, the entry date is decisive). E2: Company profile Company profile including organisational chart, legal form, size, number of em-ployees, market position. This documentation must also be produced for subsuppliers. Any others involved are to be listed together with their assigned roles. E3: Overall responsibility Confirmation from the tenderer that it will assume overall responsibility for this project, i.e. particularly that the tenderer is the awarding office's sole contracting party. E4: SPOC administrative business processes The tenderer confirms, in the event of being awarded the contract, that it will provide a contact point, the socalled "single point of contact" (SPOC) for all administrative matters. This SPOC is the contact point e.g. for orders, payment transactions, services, escalation of problems, etc. Information required: surname, first name, email address and telephone number and the same for the deputy. E5: Repairs (hotline) Confirmation from the tenderer that it will maintain technical support in German or French. This must be available on business days from 8am to 5pm (procuring entity's office hours) and must be able to give or pass on reliable information. Calls are to be charged at local rates (no 0900 numbers). E6: Training Upon delivery of the appliances, the tenderer must be able to provide onsite training in Switzerland (minimum of half a day) in German and French (depending on the linguistic region). E7: Business language The tenderer confirms that any correspondence, negotiations and documentation will be in German, French or English. This also includes contact and exchanges during the installation work. E8: Service network The tenderer has at least one branch in Europe with at least 5 fulltime equivalent (FTE) employees and a service network including spare parts supply. E9: Appliance presentation The tenderer confirms that at the second level of the procedure (invitation to submit a tender) it will present to the procuring entity an appliance which has been set up and is operating (presentation in accordance with section 4.4 of the requirements 1). E10: Draft contract Confirmation from the tenderer that it accepts the draft contract. E11: General Terms and Conditions for the Purchase and Maintenance of Hardware Confirmation from the tenderer that it accepts the Confederation's general terms and conditions for the Purchase and Maintenance of Hardware (Edition 20.10.2010).
Suitability criteria with evaluation The tenderer must draw up separate documentation for the assessable suitability criteria with supporting evidence. E12: Proven experience The tenderer has proven technical knowledge to be able to fully perform the services for which tenders are invited. E13: Reaction time The tenderer guarantees a maximum reaction time of X hours concerning services and repairs, i.e. until the mechanic is on site. As proof, reference lists from the last 12 months concerning servicing of at least 3 customers must be enclosed. E14: Quality management The tenderer works in accordance with a quality management system. As proof we expect a copy of the certificate or quality management manual containing at least a description of the process map and the procedural organisation. E15: Spare parts supply The tenderer guarantees the supply of spare parts for X years after the x-ray machines have been delivered. This information from the tenderer is a contract component and must be complied with. E16: Guarantee The tenderer confirms that a guarantee for X months without incurring any costs will be provided. This information from the tenderer is a contract component and must be fulfilled. E17: Delivery times x-ray machines (small) Prompt delivery will be advantageous for swift project implementation. The tenderer must indicate the delivery deadline from the date of order. E18: Delivery times x-ray machines (medium) Prompt delivery will be advantageous for swift project implementation. The tenderer must indicate the delivery deadline from the date of order. E19: Guarantee from the tenderer for repairs and maintenance work The tenderer provides a guarantee to the FCA for X years that repairs and maintenance work for the x-ray machines proposed can be carried out with the corresponding expertise. The amounts specified must be confirmed in writing with a legally binding signature and are part of the contract. E20: Delivery scope The tenderer confirms that X machines which are comparable in terms of technology, size and quantity have been delivered in the last five years. These have been installed and are in operation.

The appeal petition must be submitted in duplicate and must contain the application, the grounds of appeal with details of the evidence and the signature of the appellant or his agent; a copy of the present publication and documents cited as evidence must be attached, provided they are in the appellant’s possession.
